8. Limitation of Liability

To the maximum extent permitted by law, Kesho and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service
• Any conduct or content of third parties on the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us, if any, in the 12 months preceding the claim, or $100, whichever is greater.

If you are located outside India, you agree that any disputes will be resolved through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996, or through the courts of India, at our discretion.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kesho regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
